TP/5906/2024 (E-filing) Mr. Nomaan Coatwala, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. Upon perusal of the petition, It is noticed that the prayer clause is incorrectly drafted hence, Advocate to correct the prayer clause and re-upload the corrected petition on the official portal of the Bombay High Court. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Dilip Jadhwani being sole Executor named under the Will of deceased. The deceased namely Mohandas Jadhwani died at Mumbai on 04.07.1996. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Election Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 15.04.1996. The said Will is in English language. The Page No. 1 of the Will refers to the appointment of Executor. Only one Executor appointed under the Will who is petitioner herein.

3. Ld. Advocate for petitioner submits that mother of deceased predeceased the deceased. Wife of deceased since deceased the deceased who died on 25.10.2015. Deceased had one son and three daughter. One daughter of deceased namely Neelam died as spinster on 13.10.1981. Another daughter of deceased namely Archana Sahu died issue-less on 29.04.2021. Deceased was survived by one son and one daughter. Out of them son is petitioner herein and daughter namely Poonam has been served with the citation through the office of Sheriff, Mumbai and Affidavit of Service dated 01.04.2025 is filed to that effect. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Veena Agrawal dated 25.10.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 04.04.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.

5. Office to issue Probate as soon as corrections are carried out in the prayer clause and re-upload the corrected petition on the official portal of the Bombay High Court and after verifying whether any cross petition is filed or whether any caveat is filed.
