TP/5911/2024 (E-filing) Mr. Dhruv Mishra i/b. Sagar Deb, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Jayashree Rajiv Patkar being one of the Executors named under the Will of deceased. The deceased namely Geeta Digambar Patkar died at Mumbai on 01.08.2023. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Passport is annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 20.04.2004. The said Will is in English language. The Para No. 1 of the Will refers to the appointment of Executors. Only two Executors appointed under the Will. Petitioner is one of the Executors and another executor namely Rajiv D. Patkar died on 03.05.2022 as stated in para No. 5 of the petition.

3. Ld. Advocate for petitioner submits that husband of deceased predeceased the deceased. One son of deceased namely Rajiv Digambar predeceased the deceased leaving behind his widow, one son and one daughter. Deceased was survived by one son, one daughter-in-law, one grandson and one granddaughter. Out of them daughter-in-law is petitioner herein and son, grandson and granddaughter have given their consents in favour of the petitioner. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Dr. Satyajit Deshpande dated 29.07.2024 and Rajesh Kothari dated 30.07.2024 both the Attesting Witnesses to the Will are filed. Affidavit of Service of General Citation dated 22.01.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.
