Learned advocate seeks leave add the word "Sudershan" as the name of widow. Leave is granted. Ld. Advocate for petitioner to carry out the corrections within twelve weeks from the date of uploading of this order. Ld. Advocate for petitioner re-upload the corrected petition on the official portal of the Bombay High Court. Reverification is dispensed with. After the corrections, the name of widow will be 'Sudershan Srikishan Kapoor'.

2 This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Nitin Srikrishan Kapoor being sole Executor named under the Will of deceased. The deceased namely Srikishan Kapoor died at Mumbai on 19.12.2022. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

3. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 15.02.2016. The said Will is in English language. The Para No. 1 of the Will refers to the appointment of Executor. Only One Executor appointed under the Will.

4. Ld. Advocate for petitioner submits that deceased was survived by widow and two sons. Out of them one son is given in adoption as stated in para 2 of Will of deceased and in para 8 of Petition. Another son is the Petitioner herein and widow has given her consent in favour of petitioner. Consent Affidavit is on record. There are no other legal heirs.

5. Petitioner's oath is filed. Affidavit of Dr. Beena Mahajan and Roshi Chauhan both dated 13.9.2024 both the Attesting Witnesses to the Will are filed. Affidavit of Service of General Citation dated 31.1.2025 is filed. All other legal formalities are complied with. Hence, petition is granted. .....2

6. Office to issue Probate as prayed after corrections is carried out as stated in para 1 hereinabove and after verifying whether any cross petition is filed or whether any caveat is filed.
