TP/5967/2024 (E-filing) Mr. Sachin Kudalkar i/b. Madekar & Co., Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioners namely Sumeet Rajendra Dhawan and Amit Rajendra Dhawan being Executors named under the Will of deceased. The deceased namely Rajendra Premlal Dhawan died at Mumbai on 07.11.2021. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 21.09.2018. The said Will is in English language. The Para No. 3 of the Will refers to the appointment of Gautam Mehra as and Executor and in his absence two Executors are appointed under the Will who are petitioners herein. The said Gautam Mehra by his letter dated 22.09.2022 has renounced his rights as an Executor and the said letter is annexed to the petition as Exhibit - "C".

3. Ld. Advocate for petitioner submits that parents and wife of deceased predeceased the deceased. One son of deceased namely Manish predeceased the deceased leaving behind his widow and one son. Deceased was survived by two sons, one grandson and one daughter-in-law. Out of them both the sons are petitioners herein and the grandson and daughter-in-law have been served with the citation and Affidavit dated 08.05.2025 is filed to that effect. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Mukesh Ahuja dated 12.11.2022 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 06.05.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.
