TP/5992/2024 (E-filing) Mr. Sarthak Diwan a/w. Aditya Ghadge, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioners namely Jeyesh Vasantlal Damani and Sanjay Vasantlal Damani being Executors named under the Will of deceased. The deceased namely Bhimjibhai Mithubahi Damani died at Lonavala on 24.03.2020. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 11.03.2020. The said Will is in English language. The Para No. 10 of the Will refers to the appointment of Executors. Only two Executors appointed under the Will who are petitioners herein.

3. Ld. Advocate for petitioner submits that parents and wife of deceased predeceased the deceased. Ld. Advocate for petitioner seeks leave to amend the para No. 8 of the petition in terms of section 11 r/w. Schedule Class II of the Hindu Succession Act, 1956. Leave is granted. Ld. Advocate for petitioner to carry out amendment within twelve weeks from the date of uploading of this Order. Ld. Advocate for petitioner to re-upload the amended petition on the official portal of the Bombay High Court.

4. Petitioner's oath is filed. Affidavit of Kamlesh Zariwala dated 03.04.2025 and Khetsi Malji Chandra dated 23.04.2025 both the Attesting Witnesses to the Will are filed. Affidavit of Service of General Citation dated 28.01.2025 is filed.

5. Ld. Advocate for petitioner file praecipe to place on board as and when the matter is ready for final grant.
