TP/6001/2024 (E-filing) Mr. Priyank Kulkarni i/b. Sawant Parag Dilip, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Sampada Sudhir Gajre being one of the Executrix named under the Will of deceased. Deceased namely Roopa Gopal Guttal said to have died at Mumbai on 02.05.2024. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. Ld. Advocate for petitioner submits that deceased left behind her last Will and Testament which was duly executed at Mumbai on 22.11.2018. The said Will is in English language. Ld. Advocate for petitioner submits that petitioner is one of the Executrix and remaining two executrices namely Madhavi Gautam Bhadbhade and Rajashree alias Priya Guttal have reserved their rights to come and apply for Probate later on.

3. Ld. Advocate for petitioner submits that parents and husband of deceased predeceased the deceased. Deceased had no son and was survived by three daughters. Out of them one daughter is petitioner herein and remaining two daughters have given their consents in favour of the petitioner. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Narayan G. Guttal dated 15.10.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 23.01.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.
