TP/6002/2024 (E-filing) Ms. Pushpa Thapa, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioners namely Deepak Arjandas Hingorani and Manish Hassanand Jagwani both being Joint Executors named under the Will of deceased. Deceased namely Pushpa Moti Chugani said to have died at Mumbai on 25.08.2023. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. Ld. Advocate for petitioner submits that deceased left behind her last Will and Testament which was duly executed at Mumbai on 08.08.2023. The said Will is in English language.

3. Ld. Advocate for petitioner submits that parents and husband of deceased predeceased the deceased. Deceased had no children from the said wedlock. There are no relatives from the husband side. Brother of deceased and his wife both predeceased the deceased. The said brother of deceased died leaving behind two sons and one daughter. Deceased was survived by two nephews and one niece. Out of them one nephew is petitioner herein and all other legal heirs have given their consents in favour of the petitioner. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Suraj Amar Wadhwa dated 26.10.2023 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 31.01.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.
