TP/6005/2024 (E-filing) Ms. Yogini Gada, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Jayesh Meghraj Veera being sole Executor named under the Will of deceased. The deceased namely Ratanben Hirji Chheda died at Mumbai on 09.04.2017. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copies of Aadhaar Card and Pancard are annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 31.12.2016. The said Will is in Gujarati language. Ld. Advocate for petitioner has filed translation of the Will alongwith Affidavit dated 19.03.2025 stating that true and correct translation. The Page No. 2 of the Will refers to the appointment of Executor. Only one Executor appointed under the Will.

3. Ld. Advocate for petitioner submits that husband of deceased predeceased the deceased. Deceased had no son and had five daughters. Four daughters of deceased died. Out of five daughters one daughter namely Rekha has given her consent in favour of petitioner. Daughter of deceased namely Asha died as spinster and other three daughters are survived by one daughter each. All the legal heirs have given their consents in favour of the petitioner. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavits of Jaykumar Shamji Lalan and Mahendra Ratanshi Shah both dated 05.11.2024 both the Attesting Witnesses to the Will are filed. Affidavit of Service of General Citation dated 11.02.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.
