1. Ld. Advocate for the petitioner moved a praecipe dated 08.04.2025 and thereby submitted that in order dated 25.03.2025, name of the petitioner no. 3 is wrongly mentioned, marital status of the deceased is also incorrect and capacity of the petitioner and relation is also not mentioned. Hence, same may be corrected.
2. I have heard the Ld. Advocate for the petitioner and after perusal of the petition, in order dated 25.03.2025, name of the petitioner no. 3 is corrected as "Stalin Thomas Athavan", marital status of the deceased is corrected and read as "Widow". Furthermore, para no. of the Order dated 25.03.2025 is corrected and re-produced as under; "6. Ld. Advocate for the petitioners submitted that in view of provisions of the Indian Succession Act, 1925, the petitioners no. 1 and 3 being sons and Petitioner no. 2 being daughter of the deceased, are entitled to seek a Letters of Administration. Hence, facts stated by petitioners, on oath, remained unchallenged and required to be accepted. Accordingly, petition deserves to be allowed, as prayed for. Hence, following order:"
3. It is made clear that rest of the order dated 25.03.2025 will remain as it is.
4. Removed from the board.
