1. The Ld. Advocate for the Petitioner submits that the marriage of the deceased solemnizes under the provisions of the Special Marriage Act, 1954 and therefore provisions of the Indian Succession Act, 1925 are applicable. However, there is no averment in the petition's paragraph No. 4.

2. In view of such submission, the petitioner to take steps to aver these facts about the application of the Law, relating to the succession. Furthermore, the petitioner to mentioned the other legal heirs as per provisions of the succession Act, applicable to the deceased.
