PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Succession Certificate in respect of certain debts belonging to deceased filed by petitioner namely Sachin Ramesh Solanki, who is Son of deceased. Deceased namely Ramesh Dayalal Solanki, said to be died intestate at Mumbai on 03.07.2020. Copy of death certificate is annexed to the petition as Exhibit - "A". Identification proof of deceased viz. copy of Aadhaar Card is already annexed to the petition as Exhibit - "A-1".
2. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Wife of the deceased predeceased the deceased who died on 15.10.2011. One Son namely Anil died as bachelor and another son namely Dheeraj predeceased the deceased, who died on 15.03.2016, his wife namely Hema died on 25.02.2017, who survived by Kinjal Dheeraj Solanki, who is minor Grand Daughter of the deceased. Therefore, Deceased was survived by one son and one Grant Daughter. Out of them son is petitioner herein. The petitioner has agreed to deposit 50 % Share of the Minor Grant Daughter namely Kinjal Dheeraj Solanki in this Hon'ble Court as an when he received the said amount from the RBI/ Concerned Authority mentioned by an Affidavit dated 03.03.2025 which is separately uploaded.
3. The petitioner is required to justify the surety by depositing the share of minor Grant Daughter. This Hon'ble Court by an order dated 23.12.2025 passed in Judges Order No. 345 of 2025 has dispensed with the justification of surety prior to the grant and petitioner is permitted to deposit Rs.11,23,433.85 (50% share of the minor) within four weeks of the receipt of the dues from the concerned authorities, after the grant of Succession Certificate is issued with the office of the Prothonotary and Senior Master, High Court, Bombay. All other legal formalities are complied with. Hence, petition is granted.
