TP/6097/2024 (E-filing) Mr. Chetan Chauhan i/b. Vishaki Bhatia, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Succession Certificate in respect of certain debts belonging to deceased filed by petitioner namely Deepak Vishwanath Arte being brother of deceased. Deceased namely Aparna Vishwanath Dabke said to be died intestate at Thane on 21.12.2021. Copy of death certificate is annexed to the petition as Exhibit - "A". Identification proof of deceased viz. copy of Aadhaar is already annexed to the petition as Exhibit - "A-1".
2. Ld. Advocate for petitioner submits that husband of deceased namely Vishwanath Narayan Dabke predeceased the deceased. Deceased died issueless. Parents of husband of deceased predeceased the deceased. Husband of deceased had no brother and sister. Husband of deceased had no uncle or aunt. There are no agnates and cognates from the husband side of deceased. Deceased had one sister and two brothers. Sister of deceased died on 15.10.2023. She died issue-less. Deceased was survived by two brothers. Out of them one brother is petitioner herein and another brother has given his consent. Consent Affidavit is on record. There are no other legal heirs.
3. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 21.02.2025 and Administration Bond dated 25.02.2025 are filed. Delay is explained. All other legal formalities are complied with. Hence, petition is granted.
