TP/6100/2024 (E-filing) Ms. Pratiksha Babar i/b. Sujata Babar, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Sandip Dagdu Shedge being sole Executor named under the Will of deceased. The deceased No. 1 namely Pandurang Krushna Bamane died at Karad, Satara on 23.05.2020. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition. The deceased No. 2 namely Gangubai Pandurang Bamane died at Satara on 03.11.2023. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. Both the deceased left behind their last Will and Testament which was duly executed at Mumbai on 24.12.2019. The said Will is in Marathi language and translation of the said Will is annexed to the petition alongwith Affidavit of Advocate dated 05.02.2025 is filed to that effect. The Para No. 4 of the Will refers to the appointment of Executor. Only one Executor appointed under the Will who is petitioner herein.

3. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Both the deceased were died issue-less. Deceased No. 1 was survived by one brother and one sister. They have been served with the citation through the office of Sheriff, Mumbai and Affidavit dated 27.02.2025 is filed to that effect. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavits of Dakshata Dattaram Chavan and Rohini Sunil Mardhekar dated 23.11.2024 both the Attesting Witnesses to the Will are filed. Affidavit of Service of General Citation dated 27.02.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.

5. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed.
