TP/6143/2024 (E-filing) Mr. Prabhu Velar a/w. Bhakti Patil i/b. Sharma Anoop Kumar, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Kulin Bhagwandas Ramdas being one of the Executors named under the Will of deceased. The deceased namely Bhanubai Bhagwandas died at Mumbai on 14.04.2023. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 16.10.2012. The said Will is in Gujarati language and translation of the Will is annexed to the petition. Affidavit of Advocate for petitioner dated 02.07.2025 is filed certifying that true and correct translation of the Will. The Para No. 1 of the Will refers to the appointment of Executor. Only three Executors appointed under the Will. Petitioner is one of the executor and other executrices namely Sunil Atul Shah and Atul Vadilal Shah have reserved their rights to act as an Executrices and Affidavits dated 30.07.2024 are filed to that effect.

3. Ld. Advocate for petitioner submits that parents and husband of deceased predeceased the deceased. Deceased was survived by one son only who is petitioner herein. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Kamlesh Uttamchand Jhaveri dated 08.07.22024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 03.02.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.
