Heard Mr. Bansode, learned Advocate for Petitioner. 2.

Present Petition is filed for issuance of Legal Heirship Certificate under Section 2 of Bombay Regulation VIII of 1827 in respect of the deceased abovenamed.

Petitioner is the son of the deceased. In paragraph No. 4 details of legal heirs of the deceased are mentioned. Deceased had two wives. Insofar as legal heirs mentioned at Sr. Nos. 1 to 5 are concerned, Petitioner has taken steps to issue proclamation pursuant to the order passed by this Court previously. In that regard, Mr. Bansode today files affidavit of service dated 10.09.2025. Perusal of the affidavit and annexures appended thereto show that despite the packets having been served, acknowledgment is not received against the consignment

13. MPT-210-2025.odt till date. Consignment / Parcel track report is also appended to the affidavit of service.

In view of the fact that prayer in the Misc. Petition is for the Petitioner and for all other legal heirs mentioned in Petition to be declared as legal heirs, there can be no impediment in allowing the Petition. Petition is therefore allowed in terms of prayer clause (a). Compliane to prayer clause (b) is accepted in view of the affidavit of service dated 10.09.2025.

Department shall issue the Legal Heirship Certificate in the name of Petitioner and other legal heirs which are mentioned in paragraph No. 4 except those who are deceased and issue grant within a period of three weeks from today subject to all other compliances. 6.

Misc. Petition is allowed and disposed.
