Heard Mr. Yadav, learned Advocate for Petitioner and Mr. Jain, learned Advocate for Respondent.

Request is made by Mr. Jain that on 05.12.2025 at the time of rising in the evening stating that in the morning session order was passed in present Misc. Petition allowing the said Petition in view of the absence of Respondent and his Advocate. He would submit that on that date, he was engaged in another matter before another Court and that is the reason why he could not come to Court. He would submit that Respondent (Org. Petitioner) has a good case on merits which he has voiced to me today. He would therefore persuade the Court to set aside the order dated 05.12.2025 and permit the

MPT-480-25.odt Respondent -original Petitioner to file affidavit in reply, which he undertakes to file within a period of one week from today and to serve a copy thereof upon Mr. Yadav in advance. Copy of the reply has been handed over to Mr. Yadav in Court before me. Mr. Yadav shall file his rejoinder before the next date.

In view of the above, order dated 05.12.2025 stands set aside and Misc. Petition shall be heard afresh by this Court on merits on the next adjourned date.
