Heard Mr. Rode, learned Advocate for Petitioner. 2.

Legal heirship certificate is sought in respect of property and credits of the deceased. One of the legal heir namely Rohit Anant Patil, the son of the deceased has not given his consent. 3.

Learned Advocate informs the Court that for the past five months, mediation is in progress to arrive at an amicable settlement but it has failed.

He would submit that immovable property of deceased is in custody and possession of Rohit Anant Patil who is the son of the deceased. He would submit that copy of this Petition has been served on Rohit Anant Patil. Today, when the Petition is called out he is not present. He is directed to remain present on the next adjourned date. 5.

Mr. Rode informs the Court that heirship certificate is sought for

14.MPT.639.2024..doc in respect of all legal heirs including Rohit Anant Patil, whose names are stated in paragraph No.4.

If that be the case, there can be no impediment in allowing the present Petition.

Copy of this order shall be served on Rohit Anant Patil. If he does not remain present on the next adjourned date, the Petition shall stand allowed for Grant of legal heirship certificate in the names of all legal heirs mentioned in paragraph No.4 of the Petition. 8.

Stand over to 10th October, 2025. To be placed under the caption 'For Orders'.
