When the above Appeal had come up on 16th January 2026, we passed an order taking a prima facie view that we do not find any reason to interfere with the order passed by the learned Single Judge. Be that as it may, since the learned Advocate appearing for the Appellant submitted that they have recently come on record and require time to address the Court on merits, we had placed the matter on board today to enable the Advocates for the Appellant to address us on merits. 7-APP-76-2024.doc Appellant that after hearing the Appellant in the above Appeal, if we find no merits, we may dismiss the above Appeal by imposing heavy costs on the Appellant.

Today, when the matter is called out, the learned Senior Counsel appearing for the Appellant has tendered to the Court a letter received from the Appellant giving instructions to withdraw the above Appeal. The said letter is taken on record and marked "X" for identification. 3.
In light of the above letter, the above Appeal is dismissed as withdrawn. No order as to costs.
