DATE:
DECEMBER 4, 2025 P. C.
1.
In an Order dated 30th August 2024 passed by this Court, statement made by the Respondents herein that they would vacate the flat by 9th November 2024 was recorded. This statement was accepted by the Court. 1/3
2.
In violation of the said statement, the Respondents did not vacate the flat by 9th November 2024. In these circumstances, the present Contempt Petition has been filed.
3.
The learned Advocate appearing on behalf of the Respondents states that the Respondents will vacate flat No.705, 7th Floor, Shanti Niketan SRA, Near Pawar Public School, Kandivali (W), Mumbai 400 067 [hereinafter referred to as "the said flat"] on or before 31st May 2026. This request is made as the Respondents have children who are studying in the School and their academic year would end by that time. 4.
In these circumstances, purely by way of a last chance and in order to show mercy to the Respondents, they are directed to vacate the said flat on or before 31st May 2026. The Respondents shall file an undertaking, within a period of two weeks, in this Court that they would vacate the flat on or before 31st May 2026.
5.
If the Respondents do not vacate the said flat by 31st May 2026, then the Inspector in charge of Kandivali Police Station is directed to take steps to forcibly evict the Respondents and their family from the said flat on 2/3
or before 7th June 2026. The Inspector in charge of the Kandivali Police Station will be held responsible if the Order of this Court is not executed. 6.
In the light of the aforesaid orders, in my view, no further orders are required in the Contempt Petition. Hence, the Contempt Petition is disposed of. Show Cause Notice is discharged. However, the matter is kept for compliance on 9th June 2026.
