Pursuant to the order dated 14th July, 2025, today when the matter is called out, Mr. Dubey, learned Counsel appears and submits that Ms. Sangeeta Yadav and Mr. Jitendra Mishra, who appear in the matter are not available today and that some time be granted in the matter.

Mr. Shroff, learned Senior Counsel appears for the Claimants and tenders across the bar an email addressed to Mr. Sham Walve, who had submitted a report as Amicus Curiae to the Court and on the basis of paragraph 4 of the order dated 14th July, 2025 that the parties are at Nikita Gadgil 1/2

43. N 27-25 in EXA 1624-24.doc liberty to sit with Mr. Sham Walve, learned Amicus Curaie, who had presented his report that was submitted on 3rd February, 2025. Mr. Shroff submits that there has been no response to the said email and that this Court may make the notice absolute and direct the Registry to proceed with the Execution.

This Court would have otherwise passed orders in line with the submissions made by Mr. Shroff, learned Senior Counsel for the Claimants, however, since an advisory has been received from the office of the Hon'ble The Chief Justice not to pass any adverse orders due to heavy rains, list this matter on 22nd September, 2025. 4.

It is made clear that if no progress is made on behalf of the Respondents, this Court will be left with no option but to make the notice absolute and to direct the department to proceed with the execution in the matter.
