When the matter is called out, Mr. Loya, learned Counsel appearing for the Execution Applicant and Mr. Kapadia, learned Counsel appearing for the Judgment Debtor, who undertakes to file vakalatnama within a period of one week, tender across the bar consent terms, although erroneously the consent terms are titled as minutes of order, submitting that the matter has been settled in terms of the said terms and the said terms be taken on record. That the undertakings contained in the said terms be accepted as undertakings to this Court.

Having heard the learned Counsel and having considered the submissions, the consent terms are taken on record and marked 'X' for the purposes of identification. The undertakings contained in the consent terms are accepted as undertakings to this Court. 3.

The attachment of the properties to accordingly stand vacated upon receipt of the amount mentioned in the aforesaid terms. 4.

The Execution Application to accordingly stand disposed as above.

Let vakalatnama on behalf of the Judgment Debtor positively be filed within a period of one week.
