The present Chamber Order is e-filed by the applicant for setting aside Order dated 04.03.2024, rejecting captioned Petition under O.S.Rule 986 for non-compliance of office objections.

Heard ld. Advocate for the applicant. Perused Affidavit in Support, contents of which are self-explanatory.

Ld. Advocate for the applicant submits that office objections were complied with, therefore, they were under impression that Petition would have been numbered. Ld. Advocate further submits that 30 days delay was caused in filing present Chamber Order, which was not intentional. Therefore, it is prayed that captioned Petition may be restored to file by condoning delay.

Ld. Advocate for respondent no. 2 submits for passing suitable orders in the matter.

Considering grounds in the Affidavit, the applicant has made out a case for restoration. However, delay caused in filing present Chamber Order is required to be compensated by saddling cost so that the applicant would be more diligent in pursuing matter. Hence, in the interest of justice, subject to payment of cost of Rs. 2,500/- to 'The High Court Employees Medical Welfare Fund at Mumbai' - Bank of India, Mumbai (Main) Branch, Account No. 000120110001337, IFSC CODE :

BKID0000001, the present Chamber Order is granted as prayed.
