Rungta Nikhul Kumar, Advocate for Applicant WPL/36015/2023 ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) P.C.: The present Chamber Order is e-filed by the applicant for setting aside Order dated 10.04.2024, rejecting captioned Petition under O.S.Rule 986 for non-compliance of office objections.

Affidavit of Service showing service of present Chamber Order is already e-filed. Despite of service, today, none appeared on behalf of Respondents. Heard Ld. Advocate for the Applicant. Perused Affidavit in support and Addl. Affidavit in support of the Chamber Order. It is contended in Addl. Affidavit in support that due to personal difficulty of the Applicant; as he is the resident of Gujarat, and as he could not take follow up action with his Advocate, office objections could not be removed within time and the Petition got rejected. Also, for the afore-said reasons, Applicant got to know about rejection of the Petition in the month of December. Further, for ascertaining and obtaining required formats of the Chamber Order, delay of 198 days was caused in filing Chamber Order. Ld. Advocate therefore, prays for restoration of the Petition by condoning delay of 196 days.

) ) ) ) ) ) ) ) ) ) ) ) bonafide, and substantial justice cannot be denied on technical ground. Hence, present Chamber Order is granted as prayed, by condoning delay of 198 days. The petitioner to remove office objections on the Petition and get the same registered and/or numbered within four weeks from the date of uploading of order, failing Petition to stand rejected for non-compliance of office objections under O.S.Rule 986.
