28. CHOL/14/2025 IN P.C. : The present Chamber Order is e-filed by the Applicant for setting aside Order dated 13.07.2023, rejecting captioned Petition under O.S.Rule 986 for non-compliance of office objections.
TP(L)/21918/2021 ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) Perused Affidavit in support and Additional Affidavit in support of the Chamber Order. It is contended in Additional Affidavit that on account of miscommunication between Advocate and his Clerk, office objections could not be removed within stipulated time and the Petition got rejected. It is stated in Affidavit that the Applicant is a senior citizen and suffering from various ailments. Hence, delay of 215 days is caused in filing the present Chamber Order. The Applicant has prayed to grant the present Chamber Order by condoning delay of 215 days.
Reasons mentioned in the Affidavit appear to be genuine and substantial justice cannot be denied on technical grounds. Further, the applicant has explained delay of 215 days, as aforesaid, satisfactorily. Hence, delay of 215 days caused in filing present Chamber Order is condoned and the present Chamber Order is granted as prayed.
The Petitioner to remove office objections on the Petition and get the same registered and/or numbered within four weeks from the date of uploading of order, failing the Petition to stand rejected for non-compliance of office objections under O.S.Rule 986.
