The present Chamber Order is taken out to serve the Writ of Summons upon the legal heirs of Hanu Bhika Mithapura i.e. Defendant No.7, by way substituted service as per the Schedule annexed to the Chamber Order.

Perused Schedule. The Plaintiff is seeking permission to publish the Writ of Summons in two newspapers viz. "Economic Times" at Bhavnagar in English Language and "Sandesh" at Bahvnagar in vernacular language i.e. Gujarati.

Perused the Affidavit dated 1st April, 2024 annexed to Chamber Order. It is stated in the said Affidavit that as per the directions given in the matter the Plaintiff had sent the Writ of Summons for service upon the Defendants. The Plaintiff further stated that the Writ of Summons sent to the Defendant No.7 was returned as he had expired. It is further stated by Plaintiff that the whereabouts of the Defendant No.7 and his legal heirs are not known to the Plaintiff. The Plaintiff therefore prayed that she should be allowed to publish the Writ of Summons as and by of substituted service upon the Defendant No.7.

1st April, 2024, the present Chamber order is granted, and the same is signed separately.

Applicant / Plaintiff is directed to publish the Writ of Summons in two newspapers viz. "Economic Times" at Bhavnagar in English language and one in "Sandesh" at Bhavnagar in Gujarati newspaper vernacular language, within two weeks from the date of uploading the order and file Affidavit of Service within two weeks thereafter.
