FOR DIRECTION :

1. CHOL/91/2024 Mr. Govind B. Pawar, Advocate for Petitioner In TP/3200/2021 P.C. : 1.

The present Chamber Order is taken out to serve the Citation upon the legal heirs of the deceased (Nirmalaben Jethalal Thaker) viz. Parul Pravin Gohil (Grand Daughter of the Deceased) and Neelam Kanubhai Thaker (Grand Daughter of the Deceased), by way substituted service as per the Schedule annexed to the Chamber Order.

Perused Schedule. The Petitioner is seeking permission to publish the Citation in one newspaper viz. "Janmbhoomi" in Gujarati Language.

Perused the Affidavit dated 13 March, 2024 annexed to Chamber Order.

In Para-3 of the said Affidavit, it is stated that the Petitioner had taken out the CHOL No. 5 of 2024 ...2/-

for publication of the Citation in the Daily newspapers viz. in "Fress Press Journal" (English Language) and "Nava Shakti" in Marathi Language. It is further stated in para 4 that by an order dated 16.01.2024 the citation was ordered to be published in the aforesaid newspapers. In para 6 it is stated that as per the directions, the Citation was published on aforesaid two newspapers on 26.01.2024 and filed affidavit dated 29.02.2024. It is further stated in the affidavit that an objection was raised by the office on 12th March, 2024 as to the publication of Citation in Gujarati Language and directed the petitioner to take steps.

4. The Petitioner has sought permission to publish the Citation in the newspaper viz. Janmabhoomi in Gujarati language.

For the reasons stated in Affidavit dated 13th March, 2024 ...3/-

annexed to the Chamber Order, the present Chamber order is granted, and the same is signed separately.

Publication of Citation to be published in "Janmabhoomi" newspaper vernacular language,i.e. Gujarati within four weeks from the date of uploading the order. Office is directed to issue fresh Citation, if required.

Advocate to file Affidavit annexing therewith the newspaper within two weeks once, the publication is done.
