The present Chamber Order is taken out by the applicant for setting aside Order dated 22.06.2023, rejecting captioned Petition under O.S.Rule 986 for non-compliance of office objections.

Heard Ld. Advcoate for the applicant. Perused Affidavit of the applicant. It is contended that the applicant was under impression that Advocate on record and/or staff of Advocate will comply office objections within given time, however, lateron it was learnt that captioned Petition came to be rejected for noncompliance of office objections. Ld. Advocate for the applicant submits that one opportunity may be given to pursue with the petition diligently and prays for restoration of captioned petition.

Considering grounds raised in the Affidavit and submission of Ld. Advocate for the applicant, as above, I am of the view that the applicant should not be suffered due to mistake of the Ld. Advocate/clerk of Advocate and therefore, I am inclined to consider present Chamber Order favourably. Hence, the present Chamber Order is granted as prayed.

The petitioner to remove office objections on the Petition and get the same registered and/or numbered within two weeks from the date of uploading of order, failing Petition to stand rejected for non-compliance of O.S.Rule 986.
