The present Chamber Order is filed by the applicant for setting aside Order dated 14.02.2024, rejecting captioned Petition under O.S.Rule 986 for non-compliance of office objections.
Ld. Advocate for the applicant tenders Affidavit of Service, which is taken on record. Despite service, none appeared for the respondents.
Heard Ld. Advocate for the applicant. Perused Affidavit in Support, in which it is contended that office objections were complied with and they were under impression that Petition would be registered, however, later on, they learnt that Petition got rejected for noncompliance of office objections. Ld. Advocate for the applicant submits that now he will pursue the Petition diligently once it is restored to file and accordingly, prayed for restoration of captioned Petition.
Contentions raised in the Affidavit remain uncontested for want of resistance on the part of respondents. Hence, in my opinion, the applicant has made out a case for restoration of captioned Petition. In view thereof, the present Chamber Order is granted as prayed and signed separately.
The petitioner to remove office objections on the Petition and get the same registered and/ or numbered within two weeks from the date of uploading of order, failing Petition to stand rejected for non-compliance of office objections under O.S.Rule 986.
