P.C.: 1. This Chamber Order is taken out by Advocates, M/s. Wadia Ghandy & Co. seeking discharge on behalf of Plaintiffs, Shree Ahuja Properties Pvt. Ltd. in Suit No. 760 of 2019.

2. The applicant has intimated the Plaintiffs about today's date by email dated 13.04.2024.

3. The applicant has filed Affidavit in support dated 29.02.2024. It is stated in the said Affidavit that the applicant by their letter dated 31.08.2023 addressed to the Plaintiff as its aforesaid address, inter alia, stating that despite repeated instructions being sought by them no response were received and accordingly asked the Plaintiff to collect the papers in captioned Suit. However, the aforesaid letter was returned undelivered. Pursuant thereto, vide email dated 07.09.2023 to the representatives of the Plaintiff, M/s. Wadia Ghandy & Co. once again forwarded its letter dated 31.08.2023 to the Plaintiff. Till date, no response has been received to the aforesaid letter dated 31.08.2023. A copy of the aforesaid email dated 07.09.2023 addressed by M/s. Wadia Ghandy & Co. to the representatives of the Plaintiff is annexed as Exhibit - A.

4. The Ld. Advocate/Applicant submitted that in the absence of instructions, it is not possible to represent the Plaintiffs in the matter. I am satisfied that the Ld. Advocate has substantially complied with the procedure for obtaining discharge under High Court, Original Side Rules read with the provisions and Rules framed under the Advocates Act.

In view of the above, Chamber Order is allowed and signed separately. Advocate, M/s. Wadia Ghandy & Co. have been discharged on behalf of the Plaintiffs, Shree Ahuja Properties Pvt. Ltd. in Suit No. 760 of 2019. Office to delete the name of Advocate M/s. Wadia Ghandy & Co. as Advocate for the Plaintiffs. M/s. Wadia Ghandy & Co. to communicate this Order to the Plaintiffs and thereafter, Plaintiffs to engage another Advocate, if they so desire.

Chamber Order is disposed of accordingly.
