The present Chamber Order is taken out by the applicant for setting aside Order dated 20.02.2024, rejecting captioned petition under O.S.Rule 986 for non-compliance of office objections.

Ld. Advocate for the applicant submits that the respondents were served with the Chamber Order as per Affidavit of Service, which is already on file. Despite service, none appeared for the respondents.

Heard ld. Advocate for the applicant. Perused Affidavit of the applicant. It is contended that office objections with regard to translation of documents could not be done within stipulated period since some documents were in Marathi and some documents were illegible. Ld. Advocate submits that now, he will pursue with the captioned petition diligently if it is restored to file.

Considering averments in the Affidavit, it appears that the applicant had made an attempt to remove office objections, however, for the reasons mentioned in the Affidavit, he could not comply it within time. In the present matter, despite service, none appeared for the respondents to resist contentions of the applicant. Therefore, I am of the view that the applicant deserves one opportunity to proceed in the matter. Hence, the present Chamber Order is granted as prayed and signed separately.
