The present Chamber Order is e-filed by the applicant for setting aside Order dated 14.02.2024, rejecting captioned Petition under O.S.Rule 986 for non-removal of office objections.

Ld. Advocate for the applicant submits that respondent no. 2 served with Chamber Order by way of Paper Publication and tenders Affidavit of Proving Service, which is taken on record. Ld. Advocate further submits that all respondents were served, however, none appeared for the respondents.

Heard ld. Advocate for the applicant. Perused Affidavit in Support, contents of which are self-explanatory. It is contended that despite follow up with erstwhile Advocate, he failed to pursue with the captioned Petition. Therefore, the applicant engaged present Advocate in the matter. Ld. Advocate submits that he will pursue with captioned Petition diligently and prays for restoration of captioned Petition.

Despite service, respondents choose to remain absent in the matter. Therefore, contentions raised in Affidavit, remain uncontested.

Hence, I do not hesitate rely on the same with a view that the applicant should not be suffered for the fault of Advocate, so also, he will get one opportunity to pursue with the captioned Petition. In view thereof, in the interest of justice, present Chamber Order is granted as prayed and signed separately.
