The present Chamber Order is taken out by the applicant for setting aside Order dated 20.02.2024, rejecting captioned Petition under O.S.Rule 986 for non-compliance of office objections.
Ld. Advocate for the applicant submits that the respondents are served with the Chamber Order as per Affidavit of Service dated 12.04.2024, filed on 15.04.2024.
Heard Ld. Advocate for the applicant. Perused Affidavit of the applicant. It is contended that erstwhile Advocate did not handle the matter diligently due to which office objections could not be removed within given time. It is further contended that grave prejudice would be caused to the applicant if captioned petition is not restored to file. Ld. Advocate appearing for the applicant submits that he will pursue with the captioned petition diligently and prays for restoration of captioned petition.
Ld. Advocate appearing for respondents gives no objection for restoration of captioned petition.
Considering grounds raised in the Affidavit by the applicant, and no objection of the respondents, as above, the present Chamber Order is granted as prayed and signed separately.
