CHOL/185/2024 IN WP(L)/31836/2023 ) ) ) Mr. Suraj Ghogare, Advocate for Petitioner ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) P.C. : The present Chamber Order is taken out by the Petitioner for setting aside Order dated 14.02.2024, rejecting captioned Petition under O.S.Rule 986 for non-removal of office objections. Perused Affidavit of Service showing service of present Chamber Order. It appears that Chamber Order has duly been served upon the Respondent. Perused Affidavit in Support of the Chamber Order. It is contended therein that the Petitioner was not aware that the Order dated 14.02.2024 was a conditional Order and the Petition automatically stood rejected after two weeks for non-compliance of office objections.

It is further contended that the Advocate was busy in complying with office objections in other matters and through oversight, he failed to comply with office objections in the present Petition. Further, Ld. Advocate was out of Mumbai from 22.02.2024 till 28.02.2024. If the present Petition is not restored, grave harm, loss and prejudice will cause to the Petitioner. Hence, Ld. Advocate has prayed for setting aside conditional order dated 14.02.2024 and for restoration of the captioned Petition.

Heard Ld. Advocate for the Petitioner. To my mind, reasons mentioned in the Affidavit in Support appears to be bonafide. Hence, the present Chamber Order is granted as prayed and signed separately.
