The present Chamber Order is taken out by the applicant for setting aside Order dated 26.03.2024, rejecting captioned Petition under O.S.Rule 986 for non-compliance of office objections.

Ld. Advocate for the applicant tenders Affidavit of Service dated 03.05.2024, showing service of Chamber Order upon the respondent, which is taken on record. Despite service, none appeared for and on behalf of the respondent.

Heard ld. Advocate for the applicant. Perused Affidavit of the applicant. It is contended that the applicant could not submit required documents due to his personal difficulties. It is further contended that through oversight and due to inadvertent error on the part of applicant, office objections could not be complied with, within given time. Ld.

Advcoate for the applicant submits that he will pursue with the captioned Petition diligently if it is restored to file.

Considering grounds mentioned in the Affidavit, it is seen that the applicant with all fairness contended about his inadvertent mistake, and now, ld. Advcate appearing for the applicant is ready to pursue with the captioned petition diligently, as per his aforesaid submission. Morever, none present for and on behalf of the respondent to resist contentions of the applicant. In view thereof, the present Chamber Order is granted as prayed and signed separately.
