39. CHOL/194/2025 IN P.C. : The present Chamber Order is taken out by the Applicant for setting aside Order dated 14.02.2024, rejecting captioned Petition under O.S.Rule 986 for non-compliance of office objections.

Despite service, none appeared for and on behalf of Respondent. Heard ld. Advocate for the Applicant. Perused Affidavit of the Applicant. It is contended therein that the office objections with regard to annexing typed copies of Page Nos. 27, 28, 29 and 30 in order to make the same legible. However, since the Clerk deputed to remove office objections could not comply with the said objections and the Petition got rejected. The Applicant, therefore, has requested for granting present Chamber Order.

Considering grounds mentioned in the Affidavit of the Applicant, it appears that the Applicant has made attempts to remove other office objections, except annexing types copies as mentioned above. Hence, I am of the view that the Applicant has made out a case for restoration of captioned Petition. In view thereof, present Chamber Order is granted as prayed and signed separately, upon payment of cost of Rs. 5,000/- to 'The High Court Employees Medical Welfare Fund at Mumbai' - Bank of India Mumbai (Main) Branch, Account No. 000120110001337, IFSC Code : BKID0000001.
