The present Chamber Order is taken out by the applicant for setting aside Order dated 12.03.2024, rejecting captioned Petition under O.S.Rule 986 for non-compliance of office objections.

As per Affidavit of Service dated 25.03.2025 of the applicant, respondents were served with the Chamber Order. Despite service, none appeared for the respondents, save and except, respondent nos. 3 and 6.

Perused Affidavit in Support, in which it is contended that office objections were complied with, however, further objections were raised by the office, which could not be complied with and therefore, captioned Petition got rejected. Hence, it is prayed that captioned Petition may be restored to file.

Ld. A.G.P for respondent nos. 3 and 6 submitted for passing suitable orders.

In this matter, Office has submitted Report dated 08.08.2024, informing that the applicant has not complied office objections as required.

Considering raised in the Affidavit by the applicant, Report submitted by Office and submissions of ld. A.G.P for respondent nos. 3 and 6, I am of the view that the applicant should get one opportunity to pursue with the captioned Petition. Moreover, despite service, respondent nos. 1, 2, 4 and 5 choose to remain

No prejudice would cause to the respondents if captioned Petition is restored to file since they can contest the Petition on merits. In view thereof, the present Chamber Order is granted as prayed and signed separately.

The petitioner to remove office objections on the Petition and get the same registered and/or numbered within two weeks from the date of uploading of order, failing Petition to stand rejected for non-compliance of office objections under O.S.Rule 986 without reference to this Authority.
