Mr. Chaitanya Pendse, Advocate for Petitioner / Applicant ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) P.C. : The present Chamber Order is taken out by the Petitioner / Applicant for setting aside Order dated 01.04.2024, rejecting captioned Petition under O.S.Rule 986 for non-removal of office objections. Upon perusal of Affidavits of Service, it appears that Chamber Order has duly been served upon Respondents. However, inspite of service, today none appeared on behalf of Respondents.

Perused Affidavit-in-Support of the present Chamber Order. It is averred therein that the Petitioners removed all the office objections within time i.e. on 18.04.2024. However, on 19.04.2024, the present Writ Petition was listed before the Hon'ble Court and record and proceeding was sent to the Hon'ble Court. Hence, compliance of office objections could not be verified and endorsed by the department within time and the matter got rejected. Hence, Ld. Advocate prayed for setting aside conditional order dated 01.04.2024 and for restoration of the captioned Petition.

Considering the averments made in the Affidavit in support, I am of the view that Petitioner / Applicant has made out a case to allow the present Chamber Order and restore the Writ Petition on its lodging number. Hence, the present Chamber Order is granted, as prayed and signed separately.
