The present Chamber Order is taken out by the applicant for setting aside Order dated 20.02.2024, rejecting captioned Petition under O.S.Rule 986 for non-removal of office objections.
Ld. Advocate for the applicant submits that respondents were served with the Chamber Order as per Affidavit of Service, filed on record. Despite service, none appeared for and on behalf of the respondents.
Heard ld. Advocate for the applicant. Perused Affidavit in Support, contents of which are self-explanatory. It is contended that due to medical health issues, the applicant could not supply Affidavit and legible copies of the requisite documents within given time. Ld.
Advocate for the applicant submits now they will pursue with captioned Petition diligently once it is restored to file and prays for restoration of captioned Petition by condoning delay of 23 days caused in filing present Chamber Order, which was unintentional.
Grounds raised on Affidavit, appear to be genuine and substantial justice cannot be denied on technical ground. Moreover, none appeared for the respondents to resist the present Chamber Order. Hence, I am of the view that the applicant should get one opportunity to pursue with the captioned Petition. However, it would be just and proper to impose some cost on the applicant so that the applicant would be more diligent in pursuing captioned Petition. Hence, in the interest of justice, delay of 23 days caused in filing present Chamber Order is condoned and
