The present Chamber Order is taken out by the applicant for setting aside Order dated 29.09.2023, rejecting captioned Application under O.S.Rule 986 for non-compliance of office objections.
Ld. Advocate appearing for the applicant submits that respondents were served with Chamber Order as per Affidavit of Service, which was filed on record. Despite service, none appeared for and on behalf of respondents.
Perused Chamber Order, Affidavit and Additional Affidavit in Support of the Chamber Order. Heard ld. Advocate appearing for the applicant. It is contended that the applicant is having her principal place of business at Delhi and all the papers and proceedings are maintained by the applicant in her Delhi office. It is further contended that there was communication gap between the applicant and her Advocate as well as Junior Advocate due to which office objections could not be removed within given time. Ld. Advocate fairly admits that there is considerable delay of 183 days, caused in filing present Chamber Order, which was unintentional, for which the applicant is ready to pay costs of Rs. 2,000/- to Maharashtra State Legal Services Authority. I have considered submissions and reasons mentioned in Affidavit and Additional Affidavit in Support of Chamber Order. I am satisfied with the reasons as putforth by the applicant for getting delay condoned, caused in filing present Chamber Order, and for

CHOL/228/2024 in EXAL/19082/2021 ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) restoration of Chamber Order. In view thereof, 183 days delay, caused in filing present Chamber Order is condoned subject to payment of costs of Rs. 2,000/- to the Maharashtra State Legal Services Authority within two weeks from the date of uploading of Order. Accordingly, Chamber Order is granted as prayed and signed separately.
The applicant to remove office objections on the Application and get the same registered and/or numbered within four weeks from the date of payment of costs, failing Application to stand rejected for non-compliance of office objections under O.S.Rule 986.
