Ld. Advocate for respondent no. 1 submits that respondent no. 1 was died on 17.09.2023. In the Arbitration Petition, respondent no. 1 was represented by Ld. Advocate Girish Kedia. Ld. Advocate Farid Karachiwala i/b. Girish Kedia made a statement that he is appearing on the instructions of Ld. Advocate for respondent no. 1 and they have informed names of legal heirs of deceased respondent no. 1 to the applicant's Advocate vide letter dated 09.12.2023 through Partner of J. Sagar Associates, and in spite of that, the applicant has not taken any steps to bring legal heirs on record.

CHOL/555/2024 in ARBPL/41354/2022 Ld. Advocate for the applicant submits that he is not sure whether those are only legal heirs of respondent no. 1.

In my view, once the applicant got knowledge of death of party, it is the responsibility of the applicant to bring legal heirs on record. Ld. Advocate Karachiwala has forwarded death certificate of respondent no. 1 to the ld. Advocate for the applicant. In view thereof, the applicant to take appropriate steps in the matters.
