Before : Sachin B. Bhansali Prothonotary and Senior Master Date : 10th July, 2024 FOR HEARING AND FINAL DISPOSAL :
13. CHOL/264/2024 IN WP(L)/23016/2022 ) ) ) Mr. Vineet Jain i/b. Mr. Parth Shah, Advocate for Petitioner / Applicant ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) P.C. : Instant Chamber Order is taken out for restoration of the captioned Petition, which was rejected vide Order dated 11.03.2024 for non-compliance of office objections under O.S. Rule 986.
Affidavit of Service showing service of present Chamber Order is already on record. Despite service, none appeared for the Respondents.
Perused Affidavit-in-Support of the present Chamber Order. It is stated therein that the Petitioner had provided all necessary documents to his Advocate to remove office objections. However, since some documents were illegible, office objections could not be removed in time and the matter was rejected as per conditional Order dated 11.03.2024.
Considering the averments made in the Affidavit in support, I am of the view that Petitioner / Applicant has made out a case to allow the present Chamber Order and restore the Writ Petition on its lodging number. Hence, the present Chamber Order is granted, as prayed and signed separately.
The Petitioner to remove office objections on the Petition and get the same numbered and/or registered within two weeks from the date of uploading of the order, failing the Petition to stand rejected for non-removal of office objections under O.S.Rule 986.
