The present Chamber Order is taken out by the applicant for setting aside Order dated 21.03.2024, rejecting captioned Petition under O.S.Rule 986 for non-compliance of office objections.
Ld. Advcoate for the applicant submits that the respondent was served with the Chamber Order as per Affidavit of Service, which is on record. Despite service, none appeared for the respondent.
Heard ld. Advocate for the applicant. Perused Affidavit of the applicant. It is contended that due to work load, Advocate's clerk could not remove office objections within stipulated time. Ld. Advocate for the applicant submits that she will pursue with the captioned Petition diligently if it is restored to file. In the present matter, despite service, the respondent choose to remain absent due to which contention of the applicant, as above, remains uncontested. Therefore, I do not hesitate to rely on the contention raised by the applicant in his affidavit for considering present Chamber Order favourably. Hence the present Chamber Order is granted as prayed and signed separately.
