24. CHOL/287/2024 IN P.C. : The present Chamber Order is e-filed by the Applicant for setting aside Order dated 28.03.2024, rejecting captioned Petition under O.S.Rule 986 for non-compliance of office objections.

TP(L)/35827/2022 ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) Perused Affidavit in support and Additional Affidavit in support of the Chamber Order. It is averred in Additional Affidavit that due to personal difficultly, the erstwhile Advocate discontinued to act as an Advocate for the Applicant and as a result, office objections could not be removed within stipulated time. By the time new Advocate was engaged, Petition got rejected. It is further stated that for the above-mentioned reasons, delay of 49 days is caused in filing Chamber Order which may be condoned by granting the present Chamber Order.

Reasons mentioned in the Affidavit appear to be genuine and substantial justice cannot be denied on technical grounds. Further, the applicant has explained delay of days, as aforesaid, satisfactorily. Hence, delay of 49 days caused in filing present Chamber Order is condoned and the present Chamber Order is granted as prayed.

The Petitioner to remove office objections on the Petition and get the same registered and/or numbered within four weeks from the date of uploading of order, failing the Petition to stand rejected for non-compliance of office objections under O.S.Rule 986.
