The present Chamber Order is filed by the applicants for setting aside Order dated 28.03.2024, rejecting captioned Petition under O.S.Rule 986 for non-compliance of office objections.

Ld. Advocate for the applicant made a statement that respondents were served with the Chamber Order. Despite service, none appeared for the respondents.

Heard ld. Advocate for the applicant. Perused Affidavit in Support and Additional Affidavit in Support, contents of which are selfexplanatory. It is categorically contended that at the relevant period, Advocate on record was at his native place since his mother was not keeping well and undergone surgery.

Therefore, office objections could not be complied with within given time. It is further contended that for the same reason, delay of 37 days caused in filing present Chamber Order, which was not intentional. Therefore, it is prayed that present Chamber Order may be allowed by condoning delay.

Reasons mentioned on oath, appear to be genuine and substantial justice cannot be denied on technical ground. Moreover, none appeared for the respondents to contest present Chamber Order. No prejudice would cause to the respondents if captioned Petition is restored to file since they would get opportunity to contest Petition on its own merits. Hence, I am of the view that the applicants have made out their case for restoration of captioned Petition. Hence, in

The petitioners to remove office objections on Petition and get the same registered and/or numbered within four weeks from the date of uploading of order, failing Petition to stand rejected for non-compliance of Office objections under O.S.Rule 986.
