Mr. Balbheem Patil, Advocate for Petitioner / Applicant ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) P.C. : By way of present e-filed Chamber Order, Petitioner / Applicant seeks restoration of captioned Petition, which was rejected under O.S. Rule 986 for non-compliance of office objections in view of minutes of order dated 27.03.2024.
It is contended in Affidavit-in-Support of the present Chamber Order that due to pre-occupation with the other matter, Ld. Advocate could not remove office objections within stipulated time. It is further stated that the matter is uncontested and hence, the Petition may be allowed to be restored Perused e-filed Addl. Affidavit explaining delay caused in filing Chamber Order. Upon perusal of the same, delay in filing present Chamber Order is condoned.
Considering the averments made in the Affidavit in support, I am of the view that Petitioner / Applicant has made out a case to allow the present Chamber Order and restore the present Petition on its lodging number. Hence, the present Chamber Order is granted.
At this stage, Ld. Advocate for Petitioner / Applicant submits that he has sought for two weeks time to remove office objections in the e-filed Chamber Order. However, considering the quantum of objections and rush in the department, he seeks four weeks time.
