The present Chamber Order is taken out by the applicant for setting aside Order dated 28.03.2024, rejecting captioned Petition under O.S.Rule 986 for non-compliance of office objections.

Ld. Advocate for the applicant submits that respondents were served with the Chamber Order as per Affidavits of Service, which are on record. Despite service, none appeared for and on behalf of the respondents.

Heard ld. Advocate for the applicant. Perused Affidavit in Support and Additional Affidavit to the Chamber Order, explaining delay caused in filing present Chamber Order. It is contended that some of the office objections were complied with, however, office objections with regard to translation of FIR and procuring a clean and readable copy of the Insurance Policy of ICICI Lombard could not be complied with, within given time as it took considerable time. It is contended in Additional Affidavit that at the relevant time, Advocate on record was out of Mumbai, so also, due to pressure of work, delay of 52 days caused in filing present Chamber Order, which was not intentional.

None appeared for and on behalf of the respondents to resist contentions raised by the applicant in his Affidavit / Additional Affidavit in Support to the Chamber Order. Relying on the aforesaid contentions of the applicant, I conclude that applicant has explained delay, as

In view thereof, delay of 52 days, caused in filing present Chamber Order, is condonded and present Chamber Order is granted as prayed and signed separately.

The petitioner to remove office objections on the Petition and get the same registered and/or numbered within two weeks from the date of uploading of order, failing Petition to stand rejected for non-compliance of office objections under O.S.Rule 986.
