The present Chamber Order is e-filed by the applicant for setting aside Order dated 04.03.2024, rejecting captioned Petition under O.S.Rule 986 for non-compliance of office objections.
Ld. Advocate for the applicant submits that respondents were served with the Chamber Order as per Affidavits of Service, which are on record. Despite service, none appeared for and on behalf of the respondents.
Heard ld. Advocate for the applicant. Perused Affidavit in Support and Additional Affidavit to the Chamber Order, explaining delay caused in filing present Chamber Order. It is contended that inadvertently, Advocate on record missed out Conditional Order passed in the captioned Petition and for the same reason, delay of 102 days caused in filing present Chamber Order, which was not intentional. It is further contended that Advocate on record noticed aforesaid Conditional Order in the month of July, 2024 and then, immediately filed present Chamber Order. Ld. Advocate undertakes to pursue with the captioned diligently if it is restored to file. Undertaking is accepted.
None appeared for and on behalf of the respondents to resist contentions raised by the applicant in his Affidavit / Additional Affidavit in Support to the Chamber Order. Relying on the aforesaid contentions of the applicant, I conclude that applicant has explained delay, as

In view thereof, delay of 102 days, caused in filing present Chamber Order, is condoned and present Chamber Order is granted as prayed and signed separately.
The petitioner to remove office objections on the Petition and get the same registered and/or numbered within two weeks from the date of uploading of order, failing Petition to stand rejected for non-compliance of office objections under O.S.Rule 986.
