The present Chamber Order is e-filed by the applicant for setting aside Order dated 04.03.2024, rejecting captioned Petition under O.S.Rule 986 for non-compliance of office objections.

Affidavit of Service, which is on record, shows that the respondent was served with Chamber Order, however, none present for the respondent.

Perused Affidavit and Additional Affidavit in Support of the Chamber Order, contents of which are self-explanatory. It is categorically averred that inadvertently, Advocate missed to take the note of Conditional Order due to which, office objections could not be removed in time. It is further averred that for the same reason, delay of 101 days was caused in filing present Chamber Order, which was unintentional. Therefore, the applicant has prayed for restoration of captioned Petition. Reasons mentioned, on oath, remain uncontested for want of resistance on the part of respondent.

Therefore, I rely on contentions raised in Affidavit and Additional Affidavit in Support, as above, and consider present Chamber Order favourably. Hence, delay of 101 days, caused in filing present Chamber Order, is condoned with no order as to costs and the present Chamber Order is granted as prayed.

The petitioner to remove office objections on the Petition and get the same registered and/or numbered within three weeks from the date of uploading of Order, failing Petition to stand rejected for non-compliance of O.S.Rule 986.
