1. CHOL/372/2024 [Original] in WP/627/2021 Mr. Siddharth Khedekar, Advocate for the Applicant. P.C.:

1. This Chamber order is taken out by the Advocate, Sachin Kadam for discharge on behalf of Petitioner Nos. 1, 2, 4 to 11 and 15 to 18 in the Writ Petition No. 627 of 2021. The Ld. Advocate for the Applicant has filed Affidavit of service.

2. The Ld. Advocate in Affidavit in support has mentioned the reasons for discharge.

The Vakalatnama is filed on behalf of all the Petitioners in the Petition by Advocate C. R. Sadasivan.

3. Since, the cause of action is common, two different Advocates cannot be permitted to represent the Petitioners.

4. The Ld. Advocate for the applicant has relied upon the Judgement passed in 1960 SCC online Bom 97 : AIR 1961 Bom 64 in the matter of Venkatrao A. Pai and Sons Ltd. v/s. Narayanlal Bansilal in Civil Revision Application No. 995 of 1960 decided on 02.08.1960.

5. In my view, the Judgement cited by the Ld. Advocate for the applicant is not helpful to the applicant, as per para - 3 and 5 of Judgement.

6. Chamber Order is rejected.
