Jayakar & Partners, Advocate for Petitioner / Applicant ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) P.C. : The present Chamber Order is taken out by the Petitioner / Applicant for setting aside Order dated 19.03.2024, rejecting captioned Petition under O.S.Rule 986 for non-removal of office objections. Affidavit of Service showing service of Chamber Order upon Respondents is already filed on record. Despite service, today, none appeared on behalf of Respondents.

Perused Affidavit in support of Chamber Order. It is stated in the Affidavit in support of Chamber Order that the Assistant of the Advocate handling the present matter had resigned from the firm. Thereafter, matter was assigned to new Assistant. Due to lack of communication with the prior/ erstwhile Assistant, time prescribed to remove office objections lapsed and the matter was rejected under O.S. Rule 986. Hence, Ld. Advocate prayed for setting aside conditional order dated 19.03.2024 and restoration of captioned Petition.

Considering grounds raised in the Affidavit, I am of the view that the Applicant / Petitioner should get one opportunity to pursue with the captioned Petition diligently. Hence, the present Chamber Order is granted as prayed and signed separately.

The Petitioner to remove office objections on the Petition and get the same numbered and/or registered within four weeks from the date of uploading of the order, failing the Petition to stand rejected for non-removal of office objections under O.S.Rule 986.
